LABOUR LAWS

The Firm provides legal advice and services to foreign as well as local clients on all labour/HR related issues in Pakistan including interpretation and application of labour legislation; advice and strategy with respect to CBA negotiations in addition to acting as counsels and appearing before all labour forums including labour courts, labour appellate tribunals, High Courts as well as the Supreme Court of Pakistan in labour related matters for and on behalf of its multi-facet clientele. The Firm provides assistance in relation to employee benefits, compensation, employment contracts, termination, settlements, plant closings, lay-offs, labour contracts, labour insurance, labour protection and welfare, construction of labour management systems, drafting collective bargaining agreements including first contracts and renewals; provide ongoing advice and legal representation in collective agreement administration including interpretation of the client’s rights and obligations under the collective agreement; advice on the employer’s rights to impose discipline on employees in particular circumstances, and advice and representation on all and any grievances filed by the union and if need be. The Firm also provides advice and services in relation to EOBI matters; drafting of Service/Employment Agreements (Temporary & Permanent), Consultancy Agreements and various other agreements related to the work force of our Clients.

Some of the more notable issues that the Firm has faced in court are with reference to the right to terminate employment contracts, who is a workman, whether reinstatement is permissible even if an employee has been wrongfully terminated, and compensation to an employee in the event of termination of employment.

The Firm’s expertise include tackling the issue of the transfer of employees from the employment of one entity to the next and the restructuring of employee schemes and benefits under the new employer. The firm has been dealing with the labour matters of all our regular clients, including The Hub Power Company Limited, Pfizer Laboratories Limited, GlaxoSmithKline Pakistan Limited, Syngenta Pakistan Limited, BP Pakistan Exploration & Production Inc, Kufpec Pakistan Holdings B.V., and several others. The Firm has been engaged by various clients for conducting legal audits, preparation and amendments of their Human Resource Policy, Manuals and Handbooks, and for advice on other corporate advisory matters in respect of the labour laws of Pakistan. We have provided a number of opinions on the applicability of different labour laws and regulations and our experience in undertaking due diligence reviews on compliance with labour laws is vast.
